A: Every card which allows you to take something from someone else’s hand specifically says that the card you take must be random. This means that not only can they mix them up, they are, in fact required to mix up their cards before you take something from them.
When you look at someone’s hand with the Spy, the intent is not that you get to know the order or location of the cards in their hand. Of course you’ll see an order when you look at their hand, but, since they will be mixing them up before anyone takes anything, that information is pointless to commit to memory.
The same is true of the Third Eye when looking at what’s in the Tomb. Since the Tomb Robbers specifies that you take a random card from the Tomb, you’re required to mix up the Tomb cards before taking one, so any location information gained from the Third Eye is moot.
